Dear Auntie Kate:
I am divorcing my husband.  We have a child together.  Will  being with my cousin, we want to marry, cost me my child.  PLEASE  answer, I am anxious to hear from you.  I've been looking but can  find no information.  We live in a state that finds cousin  marriages illegal. and I really would like to know if there is  any chance at all of not getting custody of my daughter once my  husband finds out what is going on.  What if he finds out after  the divorce is final.  can custody be taken away and I be  considered unfit because of my cousin relationship.

Thank you!!

Name: stressed

Dear Stressed,

I wish dear that I could give you a definitive answer, but I can't.

If you are divorcing your husband, you should retain a good family law attorney. Be frank and complete when telling him your situation. You may believe your Aunt Kate that he has heard EVERY story before, and many more embarrassing and difficult than yours.

Your Aunt Kate is aware that in general, courts prefer to err on the side of the mother and child relationship. Usually a mother must be shown to be terribly unfit to have her children taken from her. Residence in a brothel, repeated failure to complete drug rehabilitation programs, incarceration in penal institutions or convictions for child abuse would fall into this category.

Dear, if you exercise some discretion you should be all right.

But, don't take Kate's word for it. Run, don't walk to your attorney. She or he will be able to give you a straight answer that will put your mind at rest.

Best of luck dear.
